DECISIONS OF THE CONFERENCE

Decisions of the Conference shall be made through consensus. However, where consensus is not reached, the two-thirds majority principle shall apply. If two thirds majority is still not reached, that issue shall be referred to a referendum.

Therefore, under the NCC Act, a Referendum shall be held under any of these circumstances:

  • If the Conference resolves that the entire Constitution as adopted should be submitted to a national referendum
  • If there is any provision in the Mung’omba Draft Constitution on which agreement is not reached through either consensus or secret ballot; or
  • If the Conference resolves to make alterations to either Part III or Article 79 of the current Constitution of Zambia.

SITTINGS OF THE CONFERENCE

The NCC Act under Part III Section 17 mandates the Conference to hold its sittings only when Parliament is not in session.

Thus, the Conference sits from 14:00 hours to 20:00 hours on Tuesdays, Wednesdays, Thursdays while on Fridays, the conference from 09:00 hours to 13:00 hours.
